Northern Michigan Residents Want Answers from CMS Land

CMS was alerted by the Health Department, the DNR, Tip of the Mitt and industry to properly remove or contain cement kiln dust (CKD) before developing Bay Harbor. The CKD was not removed or contained. Today, CKD bulldozed and buried below the uncapped Bay Harbor golf courses, and water saturated CKD in shale pits, sends millions of gallons of hazardous leachate to the Lake Michigan shoreline.

  1. Why has CMS elected to transfer 135,000 gallons of their toxic leachate daily (containing arsenic, chromium, copper, lead, nickel, selenium, mercury and zinc) to Alba, headwaters to the major river watersheds of Northern Michigan, rather than removing or containing the cement kiln dust (CKD)?
     

  2. The 135,000 gallons of toxic leachate slated daily for the Alba well is a small percentage of the total problem occurring at Bay Harbor. Why is the Alba well so pressing of an issue, when the only problem solved by this is short term economics for CMS?
     

  3. Is it ethical for the Bay Harbor Resort to water its golf course and grounds with millions of gallons of water, creating 1,000’s of gallons of leachate that is proposed to be transported to Alba for injection in a 2,100 foot deep well?
     

  4. Could the proposed Alba well set a precedent for transfer of toxic wastes from downstate industries to Northern MI?
     

  5. Injection wells have failed and shown migration of toxins at 4,000 feet. Why would CMS pump Bay Harbor contaminants only 2,100 feet below the surface in the heart of Northern Michigan’s pristine watersheds?
     

  6. How would the Lake Charlevoix Watershed, being such an extensive area, be cleaned up if there was a failure of the proposed Alba well?
     

  7. Northern Michigan’s economic stability depends on environmental responsibility to our rivers, streams and lakes. Why would CMS Land even consider transferring their contaminated waste to the headwaters of the Jordan, Boyne, Charlevoix, Manistee, Cheboygan, Au Sable and Elk River Watersheds?
     

  8. If the tables were turned and Alba had a contamination problem, would Bay Harbor and Resort Township be willing to accept their waste?
